1. Agreement to these Terms
These Terms of Service (the “Terms”) govern your access to and use of the website operated by Preservation Systems Inc., doing business as STOR (“STOR”, “we”, “us”, or “our”), available at storitfresh.com and any successor or related URLs (the “Site”). By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Site.
2. About the Site
The Site provides information about STOR and its food-freshness products and services, including PREPStation™, FreshPans™, FreshLock, and STOR Mini™. Product descriptions, specifications, and availability are provided for general information and may change as products evolve. The Site does not process online sales. Commercial inquiries are handled directly by our team through the contact options on the Site.
3. Intellectual property
The Site and all of its content, including text, graphics, logos, product names, images, illustrations, page designs, and software, are owned by Preservation Systems Inc. or its licensors and are protected by copyright, trademark, and other intellectual property laws. STOR, PREPStation™, and STOR Mini™ are trademarks of Preservation Systems Inc. We grant you a limited, revocable, non-exclusive license to view the Site for your personal use or your organization’s internal business evaluation. You may not copy, reproduce, republish, scrape, distribute, or create derivative works from the Site content without our prior written permission.
4. User Content
“Content” means text, graphics, images, music, software, audio, video, works of authorship of any kind, and information or other materials that are posted, generated, provided or otherwise made available through the Site, and “User Content” means any content that users (including you) provide to be made available through the Site. Content includes, without limitation, User Content.
Any User Content, whether publicly posted or privately transmitted, is the sole responsibility of the person who originated such User Content. You represent that all User Content submitted by or on behalf of you is accurate, complete, up-to-date, and in compliance with these Terms and with all applicable laws, rules and regulations. You acknowledge that all Content, including User Content, accessed by you using the Site is at your own risk and you will be solely responsible for any damage or loss to you or any other party resulting therefrom. To the full extent permitted by law, we make no representations, warranties or guarantees with respect to any Content that you access on or through the Site.
As between you and STOR, you represent that you own, or have all rights necessary to grant STOR the rights below to, all User Content that you submit to the Site, and that STOR will not need to obtain licenses from any third party or pay royalties to any third party in order to use such User Content. You grant STOR a worldwide, perpetual, irrevocable, non-exclusive, sublicensable (through multiple tiers), transferable, royalty-free license and right to use, copy, transmit, distribute, publicly perform and display (through all media now known or later created), edit, modify, and make derivative works from your User Content (including, without limitation, translations) for any purpose whatsoever, commercial or otherwise, without compensation to you. In addition, you waive any so-called “moral rights” or rights of privacy or publicity in your User Content. If you make suggestions to STOR about improving or adding new features or products, or you otherwise provide feedback, reviews or testimonials, you grant STOR a worldwide, perpetual, irrevocable, non-exclusive, sublicensable (through multiple tiers), transferable, royalty-free license and right to use, copy, modify, create derivative works based upon and otherwise exploit your suggestions, feedback, reviews and testimonials for any purpose (including marketing), without any notice, compensation or other obligation to you.
You can request removal of your User Content by contacting us. In certain instances, some of your User Content may not be completely removed and copies may continue to exist in backups or archives. We are not responsible or liable for the removal or deletion of, or the failure to remove or delete, any of your User Content.
5. Forms and communications
When you submit a form on the Site, such as a commercial inquiry or an email updates signup, you agree that we may contact you by email about your inquiry or with STOR news and product updates. You can unsubscribe from marketing emails at any time using the link in any message or by contacting us. Consent to marketing is not a condition of any purchase. Personal data submitted through forms is handled as described in our Privacy Policy.
6. Mobile messaging
If STOR offers a mobile (SMS/MMS) messaging program and you opt in to it, the program terms presented at opt-in apply. In general: message frequency varies, message and data rates may apply, consent is not a condition of purchase, you can reply STOP to cancel and HELP for help, and wireless carriers are not liable for delayed or undelivered messages.
7. Acceptable use
You agree not to misuse the Site. Among other things, you will not: use the Site in violation of any applicable law; interfere with or disrupt the operation of the Site; attempt to gain unauthorized access to any systems or data; use automated means to scrape or harvest content or data from the Site; submit false, misleading, or infringing material through Site forms; or use the Site to transmit malware or unsolicited commercial messages.
8. Third-party links and services
The Site may contain links to third-party websites or rely on third-party services. We do not control and are not responsible for the content, policies, or practices of any third party. Your use of third-party websites and services is at your own risk and subject to their terms.
9. Disclaimers
The Site and its content are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. Statements about product performance reflect our own testing or cited published research; actual results vary by operation, food type, and handling practices.
10. Limitation of liability
To the fullest extent permitted by law, Preservation Systems Inc. and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Site, even if we have been advised of the possibility of such damages. To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Site or these Terms will not exceed one hundred US dollars (USD 100).
11. Indemnification
You agree to indemnify, defend, and hold harmless Preservation Systems Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to your User Content, your use of the Site, or your violation of these Terms or applicable law.
12. Governing law and venue
These Terms are governed by the laws of the State of Colorado, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Site that is not resolved informally will be brought exclusively in the state or federal courts located in Colorado, and you consent to the jurisdiction of those courts.
13. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top of this page shows when they were most recently revised. Changes take effect when posted. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
